Terms & Conditions

IMPORTANT: Please read the following details to ensure you are not charged extra for re-delivery. 

If the delivery is by Pallet Economy or Pallet Express, your plants will be delivered in pallet crates up to 1.2m x 1.2m (4ft x 4ft) wide on a lorry. Please ensure that a rigid lorry (not articulated) can get down your road and park adjacent to your property. If access is tight please note this when ordering and the courier should be able to send it on a small 7.5t lorry or a Luton Van. The courier must be able to unload the pallet (see below) or it may be returned to the depot and there is an additional charge to have it re-delivered. If you have any doubts or questions, please ring 01460 281265. The courier will leave the plants in the pallet crate and it will not be able to take it away. Please ensure you are able to dispose of the pallet crate before ordering.

It is better if someone is available to sign for the delivery. If no-one is available to sign for the plants, please note this when ordering. Unless instructed otherwise, the courier will return the order to their depot if they are unable to get a signature for delivery and there is an additional charge to have them re-delivered. The plants will be delivered between the hours of 9am and 6pm on your chosen day of delivery. If you would like the courier to ring and book in the delivery, please note this under Special Instructions and allow four working days from date of order to time of delivery. The courier will contact you to book in the delivery so please supply a telephone number that you can be reached on during business hours. Alternatively, special delivery notes can be added to the order, e.g. “Please ring 30 mins before arrival” and the courier will do their best to follow them. 

We will make every effort to deliver on the agreed date, and only use couriers that are tried and tested for their reliability and care. However, very occasionally, our couriers may not be able to deliver on your chosen day, on these occasions, we can accept no liability for delay of the goods. It is worth arranging delivery for one or two days before you plan to plant, just to make sure your plants get to you in time, especially if you are employing a gardener or landscaper to plant them for you.

If the ground is steep or rough (e.g. soil, gravel or hardcore), please arrange for someone to help the driver unload the plants by hand.  The courier will drop the wooden crate with a pedestrian pallet truck at the kerb or just into your drive if you have one. The pallet truck needs a smooth flat surface to move on, such as concrete, block-paving or tarmac. If your ground is steep or rough, please arrange for someone to help the driver unload the plants by hand.

You can pay by CardSave (part of Worldpay) or ring 01460 281265 between 9am and 5.30pm (Sundays 10am-4pm) to pay by card over the phone.

By purchasing goods from Evergreenhedging.com you enter a legally binding agreement with us on the following terms. It is important that you read and understand these terms because they affect your rights and liabilities.

CONDITIONS OF SALE

General

In these conditions of sale:
“The company”, “we” or “us” means Greenshutters Nurseries.
Company address: Greenshutters Nurseries, Fivehead, Taunton, Somerset. TA3 6PT
“The customer” or “you” means any person contracting with the Greenshutters Nurseries for the supply of products or services.
Delivery means delivery by Greenshutters Nurseries’ vehicles or any subcontractor employed by Greenshutters Nurseries directly or indirectly.
These conditions may only be modified by a variation in writing signed on behalf of the company by the Proprietor.

Delivery

Greenshutters Nurseries will make every effort to deliver on the agreed date, but if for any reason the company is unable to deliver then no liability whether in damages or otherwise for delay of whole or any part of the goods ordered arising from any cause whatsoever.

Delivery by us shall be conditional upon free access to the property. The customer must ensure that access is free from obstacles and that good, accessible roads are available for delivery vehicles to the place of delivery. We will not accept any liability for damages to property caused during delivery. Risk of damage to or loss of the Goods passes to you at the time of delivery to the customer or, if you fail to take delivery at the agreed time, the time when we tried to deliver. If the company, or its agent cannot gain access to the delivery address then additional costs may be incurred. Deliveries are made using large vehicles and it is the customer’s responsibility to inform the company if there may be an access problem. In such cases that delivery, in the opinion of the company is not possible, then the company reserves the right to cancel the order. Delivery vehicles unload using a tail lift. The delivery vehicle must be able to park in an area adjacent to the delivery address. A pallet truck is then used to manoeuvre the products off the tail lift to the kerbside delivery point. The customer, or somebody appointed by the customer, should be at the delivery point to accept the delivery.

Conditions of sale

The supply of goods or services to retail or domestic customers are governed by The Sale of Goods Act 1979 (as amended) and supplied in compliance with, The Consumer Protection (distance selling) regulations 2000 as amended by S1689 2005. The customer fully is made aware that plants are natural products. We aim to give you a clear idea of the nature of the plants we sell. However, you appreciate that plants are natural products and there are inevitably slight variations in size, shape and colour between different specimens. All sizes quoted are approximate. Illustrations, descriptions other information as to particular plants are approximate and for guidance only and where no available picture of the plants is available, we will put a generic picture of an established hedge. The plants that arrive will be individual plants that will take time to grow and form a hedge and are not established hedges. Any complaints must be made in writing by the customer within 48 hours of collection or delivery. If the customer is dissatisfied with the product then it must be returned to the company within 5 working days after the complaint has be logged. A refund will then be made for the original purchase price. All prices quoted by the company for the sale of Plants and garden products include VAT. Customers are required to pay by credit card/debit card at the time of ordering.

Orders are accepted at our sole discretion but are normally accepted if the Goods are available, the order reflects current pricing, you are based in the Delivery Area and your credit or account card is authorised for the transaction. The Goods available on our website are only available for delivery to you if you are based in our Delivery Area.

Warranties

We aim to provide top quality plants and products to our customers. Accordingly, we warrant that they will meet their specification and will be free from defects in materials and workmanship at the time of delivery. We further undertake that they will be in good condition at the time of delivery and will be of the type ordered, or if that type is not available we will let you know by e mail or telephone and, if possible, suggest a suitable alternative which is available. If you do not want the alternative suggested, you will be entitled to order another plant or cancel your order, as you wish.
We are not liable to replace a plant if has not been cared for in the appropriate manner. Plants must be planted correctly, in good, free-draining soil and watered sufficiently during the growing season (normally March to October). Plants must not be overfed. We recommend using Controlled-Release Fertiliser to avoid this.

The availability, price and colour of plants we sell to you may vary according to season and market availability. We will endeavour to confirm these details when we confirm your order for the plants or prior to delivery. If there have been any material variations, you will have the option of cancelling your order.

Payment terms

We will charge your credit card account for payment upon receipt of order unless delivery cannot be fulfilled within 30 days. Items with a lead time greater than 30 days will be charged up to 7 days prior to dispatch. We accept no liability if a delivery is delayed because you did not give us the right payment details.

If it is not possible to obtain full payment for the Goods from your account on delivery of the Goods to you, we can cancel the Order or suspend any further deliveries to you. This does not affect any other rights we may have.

We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from this website, unless this is solely due to our negligence.

Cancellation/Returns Policy

The customer has the right to cancel any product or services except perishable goods which are listed below. Any cancellation must be made within 7 days from the date of the order being placed and prior to dispatch of the goods.
Customers are required to return the goods, at their own expense, to Greenshutters Nurseries, Fivehead, Taunton, Somerset. TA3 6PT
Plants are perishable goods. All other goods are non-perishable
Perishable goods are excluded from cancellation under The Consumer Protection (distance selling) regulations 2000 as amended by S1689, 2005.

Order amendments

Any order amendments must be made before goods are dispatched, dispatch may be up to four working days prior to delivery.

Working Days

Working days are Monday, Tuesday, Wednesday, Thursday, Friday. Saturday and Sunday are not working days.

This policy does not affect your statutory rights.

Privacy Policy

Greenshutters Nurseries does not disclose buyers’ information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

Copyright Policy 

This website is owned by Greenshutters Nurseries. All of the content on this website, including photographic images, text, graphics, illustrations, and video is owned by Greenshutters Nurseries. All aspects of the website are protected by copyright and other laws concerning the protection of intellectual property.  Photographic images or any parts or derivatives of any photographic image from this website can be used by prior agreement with Greenshutters Nurseries (Contact Roger Eavis on 01460 281265) on the understanding that the image links directly back to this website (www.evergreenhedging.com) via hyperlink and that the use of the image shows a written credit with the text “Image: Copyright Greenshutters Nurseries (EVERGREENHEDGING.com)” clearly shown on or adjacent to the image.  Failure to comply with these conditions will be judged to be in breach of copyright and the use of the image will be invoiced at £750 + VAT per image per year.
